Thank you for using the Loyale Application. Your trust is important to us and we are committed to protecting the privacy and security of your personal information. This information is used to provide you with a great offer experience. Our privacy and data teams are committed to protecting the personal information we collect and helping to ensure that personal information is handled properly.

This Privacy Policy explains how Loyale collects, uses, and shares your personal information. This Privacy Policy applies to the websites, services, and mobile and software applications we own or control (the “Services”), including emails and designated portions of third-party websites and applications that link to or reference this Privacy Policy.

By using any of the Services, you are agreeing to the terms of this Privacy Policy and the Terms of Use into which it is incorporated. If you do not agree to this Privacy Policy, you should not use any of the Services or provide to us any of your personal information. 2. Updates

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes, including changes to how we share personal information, we will notify you by email or by providing notice on or through the Services prior to the change becoming effective.

3. What Information Do We Collect And Use?

(a) Information You Provide

If you create any type of account, download the application, or participate in certain activities on the Services, we may ask you to provide us with personal information that can be used to specifically identify, locate, or contact you, such as: your name (username), email address, telephone number, your nationality, date of birth, and your country / login location (and, for merchants, the name of the commercial store and its branches, store location, and the store’s social media accounts).

You may also have the option of providing us with other information about yourself that may be associated with information that identifies you, such as (but not limited to) merchant loyalty ID number, age or date of birth, gender, interests, product purchase information or receipts, zip code, and product or content preferences (including saved offers and content favorites).

It will always be your decision whether to directly provide to us your personal information. In some cases, if you decline to share personal information with us, then we may not be able to provide you with certain Services, and you may not be eligible for certain promotions. For information about how we handle user-submitted content, see Section 8.

(b) Information Automatically Collected as You Access and Use the Services

When you use or interact with the Services in any way, we may use cookies, cloud services, and other similar mechanisms to automatically collect information, including:

An identifier or personal information may be associated with the information collected using cookies and/or similar technologies. If you are accessing the Services from a mobile device, see Section 3(d) for additional automatically collected information.

Device Information and Identifier. When you use our Services or install the app on your computer, telephone, or other device, we may collect and store information about that device that helps us manage our products and services, deliver a more customized experience for you (including enabling the delivery of more relevant advertising on and off our sites), and detect and prevent fraud. If you use the scan cards or codes feature, the device ID remains associated with this device even after uninstalling the app; this identifier is used primarily to prevent fraud. A persistent identifier will be associated with any device you authenticate using your phone number.

Cookies. A cookie is generally a small text file that is downloaded to your device when you visit a site, and is then sent back to the original website on each subsequent visit or to another website that recognizes the cookie. By using the Loyale application you agree that we can place different cookies on your device. Cookies allow the website to recognize the user’s device and, for example, remember your login details so you do not have to re-type your username and password every time. These cookies can be removed; please review your browser’s settings to learn how to manage your cookies. Our Services may also use web beacons (also known as clear GIFs or pixel tags), which are tiny graphics with unique identifiers placed in the code of a webpage or email.

Third-Party Cookies and Similar Technologies. We allow third-party companies to use cookies, pixels, or other similar technologies on our Services to collect and use information such as hashed data, click-stream information, browser type, time and date, content viewed, search terms, the location of the device, a cookie identifier, and browser-related properties. These third parties include advertisers, service providers, advertising partners, affiliate-marketing networks and other companies with whom we partner. Where you provide a merchant or any other party with information about you, or if your information is taken from another source, Loyale will not be able to access or control tracking technology from that third party.

Analytics. We may use our own and third-party tracking and analytics tools (for example, Google Analytics) to better understand who is using our Services and how. These tools may use cookies and page tags to collect information such as time of visit, pages visited, time spent, IP address, and operating system.

(c) Information From Third Parties

We may receive information from third parties (including service providers, merchants, data partners and other business partners) about you, including personal information, cookies and other identifiers, information about in-store and online transactions, and demographic data. We may use this information to administer the applicable program or service, to offer you more personalized content and advertising, and for the other purposes described in Section 4.

(d) Information From Use Of Our Mobile Websites and Applications

In addition to the information described above, when you download or use one of our mobile applications, or access the Services through a mobile device, we may automatically collect information about your location and your mobile device, including (but not limited to) your operating system, device type, and advertising identifier. We may also request access to device storage, camera, microphone, Bluetooth, and other features, and permission to send you push notifications. You may decline or later withdraw location, Bluetooth, storage, camera, and microphone access, and push-notification permission, at any time using your mobile device’s system settings.

Location Services. You can choose whether or not to allow our Services to collect and use information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of our Services (including the proximity features described below) may be inaccessible or not function properly.

Location and Bluetooth (Proximity & Beacon Features)

With your permission, the Loyale app uses your device’s location (including, on supported devices, while the app runs in the background) and Bluetooth to detect when you are at or near a participating merchant’s branch. To do this we use short-range Bluetooth beacons (iBeacon) and location geofences that identify only the merchant and branch you have entered.

We use this to send you a relevant push notification when you arrive at a participating location—for example, to collect rewards, view the menu, or place an order—subject to a frequency limit so you are not messaged repeatedly. We store a record of which participating merchant you entered and the time, solely to manage how often these notifications are sent.

We do not use these features to continuously track your movements or build a history of your precise location, and we do not sell this data. This feature is entirely optional: you can grant or withdraw Location and Bluetooth permissions at any time in your device settings. Disabling them stops proximity detection and the related notifications without affecting the rest of the app.

Mobile Analytics. We use mobile analytics software to better understand the usage and performance of our mobile software on your device. This software may record information such as how often you use the application, the events that occur within the application, usage and performance data, and where the application was downloaded from. We may link this information to an account identifier or a device advertising identifier.

Third-party links. The Services may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our Services, we encourage you to read the privacy policy of every website you visit.

4. How We Use Your Information

We may use the information that we collect for the following purposes:

We combine information about you collected across different Services and devices, and with information obtained from third parties, and we may make inferences (such as product preferences and interests) to help deliver and measure tailored promotions and advertising. We retain all information we collect about you for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

5. When We Share Information

We may share personal information and other information collected or obtained about you with our affiliates and the merchants that offer rewards and offers found in the application; in all cases, they will only be able to use the information as set forth in Section 4.

We may work with other companies to operate, maintain, and deliver the Services, including to provide personalized promotions, rewards, and advertisements, and to communicate with you by email, SMS, or push notification. Those companies will have access only to the information needed to provide the applicable service on our behalf and are not permitted to use it for any other purpose. For example, if you provide a merchant loyalty ID number to load an offer, we will provide the merchant with the loyalty ID number and other information necessary to fulfill your request.

We may share personal information with other companies with your consent or as part of a specific program or feature provided in partnership with a third party. We may also share cookies or other identifiers that do not personally identify you for marketing on our behalf and to provide information about general use of our Services. We may permit our third-party service providers to aggregate or de-identify personal information to improve their own products and services.

We may share information about you if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws, respond to a court order, judicial or governmental subpoena or warrant, or in the event of bankruptcy proceedings; and to protect against fraudulent, abusive, or unlawful uses, to defend against third-party claims, to assist government enforcement agencies, and to protect the security or integrity of the Services and the rights, property, or safety of Loyale and the third parties we work with. In the event that we are acquired by or merged with a third-party entity, we reserve the right to transfer the information we have collected as part of that transaction, and will notify you of any change in ownership.

6. Your Choices

Please contact us to determine whether we control any personal information associated with your email address. If Loyale receives information about you from a third party, you will need to contact that third party directly to manage your information.

Application Accounts. If you registered a password-protected account with us, you may modify or correct your personal information and preferences at any time by logging into your account or by contacting us. Before we are able to modify or correct your personal information, you may be required to provide additional authentication to confirm your identity (for example, an SMS or text message).

Emails. You can opt out of receiving notification email alerts and other emails such as newsletters by following the instructions included in our emails, or by changing your preferences in your account settings. If you opt out of all promotional emails, we may still send you transactional or administrative messages.

Location & Bluetooth. You can turn the proximity features off at any time by withdrawing the Location and/or Bluetooth permissions in your device settings, or by disabling push notifications for Loyale.

7. Registration via Third-Party Accounts and Social Media Sharing

You may be given the opportunity to register with us via third-party accounts such as Facebook. These services authenticate your identity and may provide you the option to share certain information (such as your name and email address) with us. We may store the information you provide through such accounts and combine it with other information. Our Services may also include social media features, such as sharing widgets, which may collect your IP address and the page you are visiting, and may set a cookie. Your interactions with these features are governed by the privacy policy of the company providing them.

8. Community Forums / User-Generated Content

We may offer features that allow users to post comments, photos, video, and other user-generated content to public areas within the Services (“Community Forums”). By default, content you post to a Community Forum is public, and your account name and photo may be associated with it and displayed publicly. Please take special note that your profile and any user-generated content you post are intended for public consumption and will not be considered confidential. To request removal of your personal information from any Community Forum, please contact us.

9. Our Commitment to Data Security

The Services may use various technical, organizational, physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information as required by applicable regulations. However, as no security measures are perfect or impenetrable, we cannot guarantee the security of any information you transmit to us. For features that require a login or password, please use strong credentials, change them periodically, sign off when finished using a shared device, and notify us immediately if you believe your account has been compromised.

10. Our Commitment to Children’s Privacy

The Services are not directed to children. Loyale disclaims liability where the user has not reached the age of eighteen (18).

11. Your Consent

By using Loyale, you agree to the processing of your information as described in this Privacy Policy and to any amendment to this policy. The term “information processing” includes, but is not limited to, the collection, storage, registration, organization, conversion, modification, use, or disclosure of data.

12. Retention Period

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law.

13. Special Notice Regarding International Transfers

The Internet is a global environment. Loyale is a company currently based in the Kingdom of Bahrain, and therefore the personal information it collects about you may be processed in any of the countries where Loyale operates, including the GCC. The data protection laws of these countries may differ from the laws of the country where you reside, but Loyale will protect your personal information strictly in accordance with this Privacy Policy at all times, wherever it is processed. By using our Services and communicating electronically with us, you acknowledge and agree to this processing.
